QNET agrees to supply the User with access to its Internet services under the following terms and conditions set forth by this document. Terms may be modified by QNET online or in writing. Use of account after such publication will constitute User's acceptance of any modifications.

This agreement is governed by the State of Nevada. User agrees to use the service in a manner consistent with all state and national laws.

User may not allow others to access or use his/her account. User passwords and User IDs are not to be shared or distributed. Use of this account is reserved for the individual or business whose name is entered on the account. User is responsible for all activity of his account and should notify QNET in writing if his password has been compromised. The account may be suspended until a new password has been issued.

QNET is not responsible for any phone charges billed to you due to the programming of a wrong phone number into your system and will not pay for any long distance charges. Please verify with us which number you're using for your Internet Access and verify with your local phone company as to whether the given number is a local, non-toll phone call or not.

QNET reserves the right to suspend or cancel an account immediately and without prior notice due to, but not limited to, a breech of these terms, or non-payment of account balance. QNET may suspend or cancel service at any time and at their sole discretion. Any unused balance of the User's account will be returned. Users out of a term contract my cancel their service with QNET at any time. Users are required to pay for service 7 days after cancellation for dialup and web hosting services, 15 days for DSL service, and 30 days for T1, wireless or other dedicated services.

User agrees to pay all charges to his account according to the amount indicated on user's bill. User has 30 days upon receipt of their monthly bill to dispute any discrepancies. QNET may charge or institute new fees at any time after the initial service period with or without prior notice.

For all DSL one-year contracts, there is up to a $150.00 early termination fee.

User is solely responsible for the procurement and upkeep of all equipment necessary to connect to QNET.

User whose check is returned to QNET for insufficient funds will be charged a $50.00 NSF fee.

User is solely responsible for any local or long distance telephone charges accrued by connecting directly to QNET.

User is responsible for ensuring that data stored on QNET's Internet servers is properly backed up. QNET disclaims all responsibly for files residing on QNET's Internet servers. QNET and its providers assume no responsibility for any damages caused by user's use or inability to use these Internet services.

User understands that all advice, services and other information provided by third parties on the Internet are not an indication of QNET's opinion. QNET exercises no control over the information passing through the Internet and disclaims and responsibility for the accuracy of information obtained through its services.

Services provided by QNET may not be used for any illegal purposes. User shall not transmit any threatening materials. Materials protected by copyright may not be uploaded or reproduced in any way without express prior permission from the copyright owner.

User may not use the account for advertising or promotion of commercial products or services without permission from QNET. All mass mailings such as distribution lists must first be approved by QNET.

QNET is not responsible for the privacy of electronic mail or any information transferred through the Internet. E-mail should be considered unsecured.

All addresses are owned and controlled by QNET, who may change or remove any address at its sole discretion.

If an account is terminated by either party, QNET may delete user's personal files. All publicly viewable materials are subject to editing and/or deletion by QNET.

Services provided by QNET may be changed without notice. These services may include but are not limited to vendors and services offered, commands, access procedures and hours of operation.

Users must comply with all rules and regulations governing any other network accessed through QNET.

QNET is not responsible for any losses or damages suffered by user, including those caused by miss-deliveries, non-deliveries, delays, or service interruptions attributed to QNET or the user.

You acknowledge that QNET may establish general practices and limits concerning use of QNET services, including without limitation the maximum number of days that email messages will be retained by QNET, the maximum number of email messages that may be sent from or received by an account on QNET, the maximum size of any email message that may be sent from or received by an account on QNET, the maximum disk space that will be allocated on QNET's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access QNET in a given period of time. You agree that QNET has no responsibility or liability for the deletion or failure to store any messages and other communications or other content maintained or transmitted by QNET. You acknowledge that QNET reserves the right to remove accounts that are inactive for an extended period of time. You further acknowledge that QNET reserves the right to modify these general practices and limits from time to time.

User must be at least 18 years of age. If user is less then 18, this agreement must be signed by a parent or legal guardian, who will be held responsible for all account balances.

QNET may enforce or not enforce any part of this agreement. Non enforcement of any of these terms does not imply consent. Should any part of this agreement be found to be unenforceable, the remainder of the agreement will remain intact and binding.

User agrees to pay reasonable attorney fees and/or all other legal costs arising out of any breech of the terms of this agreement.
